These Terms of Use govern access to the FranMantra website, product documentation, trial environments, and any related pages, portals, or hosted resources made available by FranMantra.

  1. Acceptance
  2. By accessing the FranMantra website, documentation, or hosted resources, the user agrees to these Terms of Use and any additional terms referenced in them.

  3. Permitted access
  4. The website and documentation may be used only for lawful purposes connected to product evaluation, procurement, training, support, implementation, or business operations. FranMantra publicly offers product information, feature descriptions, and documentation for its franchise CRM platform, and these resources are intended for legitimate business use.

  5. Prohibited conduct
  6. A user may not:

    • Attempt unauthorized access to any account, environment, or network.
    • Introduce malware, harmful code, or abusive automation.
    • Scrape protected resources in violation of applicable law or contractual restrictions.
    • Interfere with platform performance, security, availability, or other users’ access.
    • Use the website or application to infringe intellectual property, privacy, confidentiality, or data-protection rights.
  7. Accuracy of information
  8. FranMantra may update website content, documentation, features, or service descriptions at any time. Product marketing pages and public documentation may describe capabilities, but final commitments should be controlled by signed commercial documents and applicable service terms.

  9. Third-party links and integrations
  10. The website or platform may contain references to third-party services or support integrations. FranMantra is not responsible for third-party content, privacy practices, or service availability except to the extent stated in a separate written agreement.

  11. Suspension
  12. FranMantra may suspend or restrict access where necessary to protect security, comply with law, prevent misuse, maintain service integrity, or investigate suspected violations.

  13. Governing law
  14. These Terms of Use are governed by the laws of United States, unless a separate written agreement provides otherwise.

SOFTWARE SUBSCRIPTION TERMS

These Software Subscription Terms apply to access to hosted FranMantra services, including application access made available through the FranMantra login environment.

  1. Subscription model
  2. FranMantra provides customer relationship management and franchise operations functionality through a hosted platform. Public product pages describe capabilities including lead handling, pipeline visibility, workflow support, document management, role-based access, and compliance-oriented controls.

  3. Grant of rights
  4. Subject to payment of fees and compliance with these terms, FranMantra grants the customer a limited, non-exclusive, non-transferable right during the subscription term to access and use the hosted service for the customer’s internal business operations.

  5. User administration
  6. The customer is responsible for:

    • Assigning appropriate user roles and permissions.
    • Maintaining credential confidentiality.
    • Deactivating departed users promptly.
    • Ensuring that use of the platform complies with applicable law and internal policy.
  7. Customer data
  8. As between the parties, the customer retains rights in customer data submitted to the service, subject to rights necessary for FranMantra to host, process, secure, support, back up, and maintain the service. FranMantra’s public materials refer to secure data handling, role-based access, document access controls, and backup-oriented operational features, which should be reflected in actual service delivery practices.

  9. Restrictions
  10. The customer may not:

    • Resell or lease the hosted service without written authorization.
    • Circumvent technical controls or usage limits.
    • Use the service for unlawful surveillance, spam, fraud, harassment, or rights violations.
    • Attempt to derive source code from hosted components except where an applicable open-source license or law expressly permits this.
  11. Fees and renewal
  12. Fees, billing cycles, taxes, renewal terms, and any implementation charges must be stated in the applicable order form, proposal, or commercial schedule.

  13. Suspension and termination
  14. FranMantra may suspend service for non-payment, material breach, security threats, illegal use, or urgent maintenance needs. Either party may terminate according to the contract term, renewal schedule, and cure rights set out in the applicable commercial agreement.

MASTER SERVICE TERMS

These Master Service Terms govern implementation, onboarding, configuration, support, maintenance, and other professional or managed services provided in connection with FranMantra subscriptions.

  1. Services covered
  2. Services may include discovery sessions, business-process mapping, tenant setup, user-role configuration, workflow configuration, integration assistance, onboarding, administrative training, and support coordination.

  3. Assumptions
  4. Project timelines and deliverables depend on timely customer participation, access to required business stakeholders, availability of source data, readiness of third-party systems, and prompt decision-making.

  5. Change control
  6. Any request that materially changes scope, integrations, data migration volume, security requirements, customization effort, or training commitments may require a written change order covering timing, fees, and responsibilities.

  7. Customer obligations
  8. The customer must:

    • Provide accurate business requirements and legal instructions for data handling.
    • Ensure it has the right to provide any uploaded or migrated data.
    • Appoint an internal project owner.
    • Cooperate in testing, sign-off, and issue verification.
  9. Service dependencies
  10. Where services rely on third-party hosting, email delivery, telephony, analytics, APIs, or customer systems, performance may depend partly on those external providers.

  11. Confidentiality
  12. Each party must protect non-public business, technical, security, and commercial information received from the other party using reasonable safeguards and may use it only for contract performance, compliance, or rights enforcement.
